Terms of Service

1. Acceptance of Terms
By downloading, installing, or using the ValueTCG Terminal mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legal agreement between you and Value TCG Cards ("we," "our," or "us").
2. Description of Service
ValueTCG Terminal is a mobile application that provides trading card game (TCG) price information, collection management, and related services. The App may include both free and premium subscription features.
3. Account Registration
To access certain features of the App, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities under your account
4. Subscription and Billing
Premium features may require a paid subscription. Subscriptions are processed through the App Store (iOS) or Google Play Store (Android). By purchasing a subscription, you agree to:
- Pay all applicable fees through your platform's payment system
- Automatic renewal unless canceled through your platform's subscription management
- No refunds except as required by applicable law or platform policy
- Platform-specific cancellation procedures (iOS Settings > Apple ID > Subscriptions, or Google Play Store > Account > Subscriptions)
We do not have access to your payment information, which is handled exclusively by Apple or Google.
5. User Conduct
You agree not to:
- Reverse engineer, decompile, or disassemble the App
- Use the App for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the App's functionality
- Scrape, harvest, or collect data from the App using automated means
- Violate any applicable laws or regulations
- Upload or transmit harmful code, viruses, or malware
6. Intellectual Property
The App and its content are owned by Value TCG Cards and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. All rights not expressly granted are reserved.
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will be uninterrupted or error-free
- Defects will be corrected
- The App is free of viruses or harmful components
- Price information or other data will be accurate or current
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, VALUE TCG CARDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify and hold harmless Value TCG Cards from any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use of the App, violation of these Terms, or infringement of any third party's rights.
10. Governing Law
These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict of law principles. Any disputes will be subject to the exclusive jurisdiction of the courts located in the State of Texas.
11. Dispute Resolution
Before filing any lawsuit, you agree to first contact us at support@valuetcgcards.com to attempt to resolve any dispute informally. If we cannot resolve the dispute within 60 days, either party may pursue formal legal action.
12. Changes to Terms
We may modify these Terms at any time by posting updated Terms in the App. Material changes will be communicated through the App or via email. Your continued use of the App after changes become effective constitutes acceptance of the updated Terms.
